The Delhi High Court has intervened to protect a Pakistani Hindu Refugee Camp located at Majnu Ka Tilla from imminent demolition, directing authorities to refrain from taking any coercive action. Justice Mini Pushkarna issued a notice to the Delhi Development Authority (DDA) and the Centre following a petition against a public notice issued on March 4, which threatened to demolish the camp if residents did not vacate.

The court’s interim order, issued on Tuesday, highlighted a previous statement made by the Centre supporting Pakistani nationals belonging to minority communities. Referencing an order from May 29, 2013, wherein the Union of India pledged to provide support to the Hindu community migrating from Pakistan, the court directed authorities to abstain from any coercive measures against the petitioners until the next hearing scheduled for March 19.

The petitioner has emphasized the need to preserve the refugee camp until an alternative piece of land is allotted, particularly in light of the Citizenship (Amendment) Act, 2019, which safeguards persecuted non-Muslim minorities from Pakistan, Afghanistan, and Bangladesh.

According to the petitioner, Pakistani Hindu refugees have resided in Majnu Ka Tilla for years, with basic amenities provided by authorities, and their children attending nearby government schools. However, the DDA’s counsel argued that the National Green Tribunal has mandated the removal of all encroachments on the Yamuna floodplain, including those adjacent to the Majnu Ka Tilla gurdwara.

While expressing sympathy for the petitioners, the DDA stated that it is bound by judicial directives. The court’s intervention underscores the complexity of balancing environmental concerns with humanitarian considerations, highlighting the ongoing legal battle surrounding the fate of the refugee camp.
