Rahul Gandhi’s finding in a 2019 criminal defamation case over his “Modi surname” comment was put on hold by the Supreme Court on Friday. This means that he is once again a member of Parliament. Justice BR Gavai said that Gandhi’s finding will have a lot of effects because it will also affect the rights of the people who voted for him.

Purnesh Modi, previously a minister in the Gujarat government, filed a criminal defamation case against Gandhi in 2019 for his April 13, 2019 remark at an election rally in Kolar, Karnataka. Where Rahul Gandhi supposedly stated, Why do all thieves have the same last name, Modi?
Representing Gandhi, senior attorney Abhishek Manu Singhvi argued that the case filed by BJP MLA Purnesh Modi against the Congress leader was “strange” because no one he had mentioned during his speech.
In a statement he sent to the top court, Rahul Gandhi refused once again to apologise for his comment about Modi’s last name, which led to his sentence in a defamation case and his dismissal from Parliament. Instead, he asked the Supreme Court to stop his conviction, saying he is not guilty.
He said that using the criminal process and the effects of the Representation of People Act to force the Petitioner to apologise for something he didn’t do is a gross misuse of the legal system, and this Court shouldn’t let it happen.
Gandhi said in the affidavit, the keeps saying that he is not guilty of the crime and that his punishment is not fair. He also says that if he had to apologise and make up for the crime, he would have done it a lot sooner.
